PRICE: All prices quoted exclude carriage and VAT unless otherwise stated. Carriage will be charged at applicable rates and added to the invoice. The method of carriage will be at our discretion unless requested otherwise. Following a price increase and where the customer has specified a different price on the order, we will advise the customer before proceeding.

PAYMENT: We accept payment by cheque, credit cards, banker’s draft or BACS, Goods will be despatched once payment has been cleared through the Bank unless Credit Terms are agreed.

CREDIT FACILITY: If a credit facility is agreed, payment must reach us during the month following the date of invoice (except where agreed otherwise in writing).

DELIVERY: Unless agreed otherwise, we shall dispatch using our preferred carrier. Delivery is normally made the next working day after dispatch, however no absolute guarantee can be given of this or any other delivery times. A premium service (i.e. before 9.30 am or AM delivery) can be requested at additional cost. It is our aim to deliver all orders within one week either side of the requested due date unless agreed otherwise. The quantity delivered may vary by ±10% of the ordered quantity on bespoke items.

IN TRANSIT DAMAGE: Goods damaged in transit must be signed for as damaged on the carriers receipt note and must be notified to us within 3 days of receipt. All packaging and batch numbers must be retained.

CUSTOMER’S MATERIAL: Although every endeavour will be made to ensure that free issue material is not damaged or wrongly machined in any way, we are unable to accept liability in the unlikely event that such loss occurs. As a gesture of goodwill work may be carried out on replacement material free of charge at the discretion of management.

TOOLING: Where a customer has been charged for part of the cost of any tooling required specifically for their parts, such tooling will remain the property of Agate Products Ltd. but will however be used exclusively for the production of the parts for which it was intended.

REPLACEMENT & FAULTY GOODS: Liability is limited to the replacement value of the goods or services and no liability for consequential loss will be accepted. Damaged goods will only be credited and/or replaced if notification is received within three days of delivery. Parts that are not to drawing or of an incorrect material will be replaced without time limit.

BY PLACING AN ORDER WITH US YOU ARE BOUND BY THESE TERMS UNLESS AGREED OTHERWISE IN WRITING. ALL STATUTORY RIGHTS APPLY AS PER THE STATUTES OF THE UNITED KINGDOM AND EUROPEAN UNION WHERE APPLICABLE.
